T Visa Clinical Evaluation

A T visa clinical evaluation documents the mental effects of human trafficking and how those experiences continue to affect your emotional well-being, daily life, and ability to move forward. At AFS Counseling Services, we provide ethical and culturally responsive immigration evaluations for survivors of human trafficking. Each evaluation is focused on your individual experience and the clinical questions relevant to your T visa case.

What Is a T Visa Clinical Evaluation?

A clinical evaluation for T visa cases is a clinical assessment that examines the emotional and mental effects of human trafficking.

Note: The evaluation is not a legal determination of whether you qualify for a T visa. USCIS makes that decision based on the complete record and applicable legal requirements.

Legal Factors & Potential Removal Impact

Evaluating mental factors affecting your ability to seek help or cooperate with authorities, and documenting the potential psychological impact of removal from the United States.

Who Can Seek a T Visa Clinical Evaluation?

A T visa clinical evaluation may be appropriate for survivors of severe human trafficking and exploitation. While a clinical evaluation for T visa cases does not determine whether conduct legally meets the trafficking definition, it objectively documents the mental and emotional effects of the experiences described by the client.

Labor & Physical Exploitation

Documenting psychological impacts stemming from labor trafficking, forced labor, involuntary servitude, or debt bondage.

Coercion & Sexual Exploitation

Evaluating trauma related to sex trafficking and commercial exploitation involving force, fraud, or coercion.

Psychological Control & Threats

Assessing the mental and emotional toll of trafficking involving ongoing threats, intimidation, isolation, or coercive psychological control.

How a T Visa Evaluation Can Support Your Case

A clinical evaluation for T Visa can provide independent clinical documentation that helps explain parts of your experience that may not be obvious from immigration documents alone. In T visa cases, clinical evaluations may be particularly relevant to questions involving physical presence in the United States on account of trafficking or extreme hardship involving unusual and severe harm if removed. The evaluation documents symptoms of PTSD, depression, anxiety, or coercive control resulting from exploitation to serve clinical evidence for your T Visa case.

What Includes the Clinical Evaluation for T Visa

The process is designed to be thorough without unnecessarily asking you to relive traumatic experiences.

Clinical Interview

Alice will discuss your background, trafficking experience, current symptoms, emotional well-being, and the ways the experience has affected your daily life.

Psychological Assessment

If appropriate, psychological assessment methods can be used to better understand trauma-related symptoms and current functioning.

Clinical Analysis

The evaluation information is reviewed from the mental health perspective to understand the relation between the reported trafficking experiences and emotional impact.

Written evaluation

A formal clinical evaluation is prepared based on the clinical findings. When appropriate, the report can address specific questions such as effects of trafficking, physical presence, or hardship related to removal.

Trauma-Informed and Culturally Responsive Care

Talking about trafficking can be difficult, especially when fear, shame, confusion, or lasting emotional effects are involved. Our licensed clinical therapist, Alice Solis, LCPC, uses a trauma-informed, culturally responsive approach to understand your experience and document relevant clinical information objectively. When appropriate, AFS Counseling Services can also coordinate with your immigration attorney to address relevant clinical and evidentiary questions.

Have Any Questions?

What does a T visa clinical evaluation cover?

A T visa clinical evaluation documents psychological and emotional effects of human trafficking. It may examine trauma-related symptoms, mental health concerns, functional changes, and other clinical effects connected to the trafficking experience. The evaluation can provide supporting clinical evidence for an immigration case, but it does not determine whether someone qualifies for a T visa or guarantee an immigration outcome.

Not every T visa applicant is required to obtain a clinical evaluation. An evaluation may be useful when clinical evidence can help explain the psychological effects of trafficking, the survivor's current circumstances, physical presence in the United States on account of trafficking, or potential extreme hardship involving unusual and severe harm if removed. Your attorney can help determine whether a clinical evaluation fits your case.

Working with a licensed mental health professional can provide a clinical perspective on the psychological effects of trafficking. At AFS Counseling Services, Alice Solis, LCPC conducts immigration evaluations using a trauma-informed, culturally responsive approach. The evaluation is clinical in nature, while your immigration attorney remains responsible for legal advice and case strategy.

For T visa purposes, federal law recognizes severe forms of trafficking that include certain forms of sex trafficking and labor trafficking involving force, fraud, or coercion. Labor trafficking can involve involuntary servitude, peonage, debt bondage, or slavery. Sex trafficking can involve a commercial sex act induced by force, fraud, or coercion, with additional protections for minors. A clinical evaluator does not make the legal determination of whether an experience meets the definition of severe trafficking. The evaluator documents the psychological impact of the experiences described.

If you prefer to complete your evaluation in Spanish, please contact AFS Counseling Services when scheduling so we can confirm current Spanish-language availability and discuss the appropriate arrangements for your evaluation.

After the interview and any clinically appropriate assessment, Alice reviews the information and prepares the written T visa clinical evaluation. The report is then provided securely according to the arrangements made with you and, when applicable, your attorney. Your immigration attorney can determine how and when to use the evaluation in your T visa case.
